That’s ok, some eligible businesses may also be able to claim credits from prior tax years. Eligible businesses may still have opportunities to claim previously unclaimed FICA Tip Tax Credits, subject to applicable filing deadlines.

If your business operates in food service or qualifying beauty services, this tax credit deserves a closer look.

When your employees report tips, your business pays the employer’s share of Social Security and Medicare tax (7.65%) on those tips. The FICA Tip Credit under IRC §45B gives much of that money back as a dollar-for-dollar credit against your federal income tax. It has been in the tax code for years, but many eligible businesses have never claimed it.

Businesses whose W-2 employees customarily receive tips may qualify. Restaurants, bars and cafés have been eligible for years. Starting with the 2025 tax year, the credit also covers additional business in the personal services industries.

It depends on your reported tips, the hours your tipped staff work and the cash wage you pay. As a rough guide:

  • A restaurant with about $180,000 in reported tips a year may claim roughly $13,800 per year — around $41,000 across three years for which an amendment to previously filed taxes can be made.
  • A salon with about $270,000 in reported tips may see roughly $20,700 for 2025.

Businesses that pay at or above the full minimum wage in cash usually see a larger credit, because more of the tips qualify. These are illustrations, not promises — we calculate your actual number before you commit to anything.

Often, yes. Food and beverage businesses can typically amend their 2023, 2024 and 2025 returns. Beauty and personal-care businesses were added starting in 2025, so there’s no reaching back before that, but if you already filed 2025 without the credit, that return may still be amended.

Nothing to find out if you qualify. If we identify a credit, our fee is 20% of the amount secured for the current year and any prior years recovered through an amended return. If we don’t secure a credit, you owe nothing.

To start, just the short estimate form. If your estimate qualifies, we’ll ask for:

  • Quarterly Form 941s
  • W-2s (Box 7 shows reported tips)
  • Payroll registers with hours and wages
  • Your business tax returns for the years we’re claiming

We prefer cases with at least $20,000 in estimated total credit, all years combined. That’s roughly $265,000 in reported tips across the years you may claim. For example, about $90,000 a year for a restaurant with three years available for amendment. You don’t need to be a large business: a single location with a handful of tipped employees may work with us.

Yes. It’s separate from, and can be combined with, other credits your business may qualify for, such as the R&D Tax Credit. Schedule a call here:
